If we process your personal data you can be assured that we process them with the integrity and security which is necessary. Who is the controller?

Who is the controller?

The controller for your personal data is determined based on which business area within Söderberg & Partners you are related to. Within certain business areas we are ourselves the controller, and within other business areas we are a processor on behalf of another controller. A full overview is described below.

In the cases where Söderberg & Partners is the controller this is related to one of our legal entities within the Söderberg & Partners group in Norway. See “About us” in the menu line on our website for further information. Contact information for the different business areas are described below.

This is based on which business area you are related to. We only process the personal data which is necessary in order to fulfill the purposes for our processing. A full overview is described below.

We process personal data for several different purposes. First and foremost, we process personal data in order to perform our services and to fulfill our contractual obligations. We are also obliged by law to process certain personal data for documentation, archiving and reporting. We also have a legitimate interest in marketing our services, and to contact potential clients. In addition, personal data will be processed if you have consented.

Amongst other this includes that only necessary staff has access to your personal data, and the data is secured in our systems to maintain this. In certain cases you also have the right to erasure (the right to be forgotten) or the right to restriction, i.e. that we do not longer have a legal basis for our processing or that you have withdrawn a consent for processing on which the processing is based.

You also have the right to object to our processing, i.e. if there is processing based on our legitimate interests or that we process your personal data for marketing purposes.

Finally, you have the right to data portability if we process your data based on consent or for the performance of a contract you are party to, and if the processing is based on an automatic processing. Sub-processors and transfer of personal data

To the extent that we use processors to process your personal data, they have entered into processor-agreement in accordance with GDPR, to make sure that the personal data is protected in accordance with the law and our standards. Typical categories of processors are IT-providers and IT-systems.

In other case we may transfer your personal data to other independent controllers to fulfill the purposes of the processing. We are also bound by law to provide public bodies and the authorities with information if they have legal inquiries. The recipients of personal data are described below.

If you are the contact person for a business that we are the insurance broker for we process your name, contact information and position. We will also perform necessary identity control based on our legal obligations, and therefore we may process your personal identification number and ID. If you have confirmed someone’s ID we may also process your name, contact information and personal identification number.

If you are an employee in a business we are an insurance broker for we may process your name, birth date and insurance information. If we assist in a claim we may also process the necessary information related to the claim, such as contact information and claim details.

Both the insurance information and the assistance in claims may contain special categories of personal data, like health insurance.

We may process your contact information for prospect-purposes if you are a potential client.

Without these personal data the contract could not be performed. If the information contains special categories of personal data this is for determining, exercising or defending a legal claim.

The lawfulness of processing for purpose 5 is to meet our legal obligations after act on insurance mediation, act relating to bookkeeping and act relating to the limitation period for claims. If the information contains special categories of personal data this is for determining, exercising or defending a legal claim.

The lawfulness of processing for purpose 6, 7 and 8 is that we have a legitimate interest in offering, marketing and developing our services, which we have assessed not to be in conflict with your rights and freedoms as an individual. See “Marketing and PR” for further information.

Retention

For purpose 1, 2, 3 and 4 we will process the personal data as long as there is a client relationship, and claims can be made under the insurance agreements, which is 12-22 years depending on the insurance type.

For purpose 5 the retention period will rely on legal demands after the act relating to bookkeeping and the act relating to the limitation period for claims – up to 13 years.

For purpose 6 and 8 we will process the personal data as long as there is a client relationship, or that you have consented to the processing.

For purpose 7 the personal data is updated and processed to the extent it is necessary in order to offer our services. If you have declined an offer of our services we will delete your data if it is certain that a client relationship will not be established.

For purpose 4 and 6 we will process the personal data as long as there is a client relationship, or that you have consented to the processing.

For purpose 5 the personal data is updated and processed to the extent it is necessary in order to offer our services. If you have declined an offer of our services we will delete your data if it is certain that a client relationship will not be established.

If you are a real estate buyer we collect your name, national identification number and contact information. As mentioned, we also collect information regarding the real estate transaction.

Purposes

We process the personal data in order to

  1. administer our client relationships.
  2. provide our insurance brokerage services.
  3. enter into the insurance agreement with the insurance companies on your behalf, and to identify that the correct individual enters into the agreement. This will also relate to the real estate buyer who will have potential claims in relation to the insurance agreement, and as such is a part of the agreement as well.

If you are a home seller we collect your name, personal identification number, contact information and information about the property you would like to insure from your self declaration form. We also collect information about the real estate transaction

If you are the real estate agent we collect your name and contact information.

If you are the home buyer we collect your name, personal identification number and contact information. We also collect information about the real estate transaction and the financial information you provide to us for assistance with exercising your rights under the insurance.

Categories of personal data

We process your name and contact information, personal identification number and financial information related to the insurance.

 

If we assist you in a claim we will also process the necessary information related to this, such as contact information and details about the claim. This may include special categories of personal data. We also process general information related to claims and claims history under your insurance.

We process information related to AML, such as sanctions etc.

We may process your contact information if you are a potential customer.

Purposes

We process the personal data in order to

  1. administer our client relationships,
  2. provide our insurance brokerage services,
  3. administer the insurance policies on your behalf,
  4. offer assistance in claims,
  5. fulfill our legal obligations for documentation,
  6. to market our services (see «Marketing and PR»),
  7. for prospects,
  8. to develop our services..

Where does the personal data come from?

The information may come from yourself, either if you contact us directly or that you have consented to a dealership providing us with your information in order to provide you with an insurance offer. We also receive information from the insurance companies in order for us to follow up on our client relationship with you.

Lawfulness of processing

The lawfulness of processing for purpose 1, 2, 3 and 4 is the performance of a contract in which you are party to, either directly or indirectly by having rights under the insurance agreement. Without these personal data the contract could not be performed. If the information contains special categories of personal data this is for determining, exercising or defending a legal claim.

The lawfulness of processing for purpose 5 is to meet our legal obligations after act on insurance mediation, act relating to bookkeeping and act relating to the limitation period for claims. If the information contains special categories of personal data this is for determining, exercising or defending a legal claim.

The lawfulness of processing for purpose 6, 7 and 8 is that we have a legitimate interest in offering, marketing and developing our services, which we have assessed not to be in conflict with your rights and freedoms as an individual. See “Marketing and PR” for further information.

Recipients of personal data

Your personal data needs to be transferred to insurance companies in order to enter into the insurance agreements.

We may also have to transfer your personal data to public bodies or the authorities if they have lawful inquiries.

We use processors in our processing, where the recipients are mostly within the EEC-area. If there are recipients outside the EEC-area this will be in accordance with the GDPR. See the section regarding processors.

Finally, your personal data may be shared within the Söderberg & Partners group for marketing purposes.

Retention

For purpose 1, 2, 3 and 4 we will process the personal data as long as there is a client relationship, and claims can be made under the insurance agreements, which is 12 years.

For purpose 5 the retention period will rely on legal demands after the act relating to bookkeeping and the act relating to the limitation period for claims – up to 13 years.

For purpose 6 and 8 we will process the personal data as long as there is a client relationship, or that you have consented to the processing.

For purpose 7 the personal data is updated and processed to the extent it is necessary in order to offer our services. If you have declined an offer of our services we will delete your data if it is certain that a client relationship will not be established.

We process your name, birth date and contact information, as well as every other information you provide in your application and interview process. We may also process data about your financial situation and criminal history for a limited period of time, if this is relevant for the position.

Where does the personal data come from?

Lawfulness of processing

In the recruitment process we process your personal data based on our legitimate interest and our legal obligations. We need to process your personal data to complete the hiring process, and as you are the one who has initiated the process between you and us by applying for the position we assess that our interest in completing the hiring process outweighs the burden this is for you. You may at any time object to our processing of your personal data, but this may naturally affect our ability to perform a necessary recruitment process with you.

Our processing of criminal history and/if you provide health information which is relevant for the position and your performance of the job will be based on your consent or our fulfillment of legal obligations.

If we process your personal data after the recruitment process has ended, and the process did not result in a job offer, the processing is based on your consent. You may at any time withdraw your consent, and you may determine which information we are to process. If you do not provide specifics we will process every information you have provided in the recruitment process, with the exception of special categories of personal data.

Retention

The personal data is stored in the period of time when the recruitment process is ongoing.

If you consent to further processing we will keep your information up to three years after the recruitment process ended, provided that you did not receive a job offer which you have accepted.

Not for the hiring process, but we may perform a credit control and we may request your criminal history if this is relevant for the position. In these cases you will be explicitly informed.

Lawfulness of processing

Subscriptions to newsletters and webinars are based on your consent. You can at anytime unsubscribe by following the provided links, or you could send an e-mail to news@soderbergpartners.no for change of information or to withdraw your consent.

Surveys and marketing of our services are based on our legitimate interests. We have assessed that our interest in optimizing our services (i.e. by surveys) and to offer you relevant services is not in conflict with your rights and freedoms as an individual. This is also applicable if you are contacted without prior having any client relationship with us. You may at any point in time contact us to object to this processing.

You may also have consented for us to contact you in order to offer our services. Such consent may be withdrawn at any time by contacting us.

Retention

For newsletters the personal data is processed as long as your consent is given.

Subscriptions to webinars are deleted after three months.

For surveys and marketing of our services the personal data is processed as long as you have a client relationship with us, and three months after the client relationship is over. If you do not have an active client relationship with us, and a client relationship is not established, we will delete your information unless you consent to further processing. If you have consented to our processing we will keep your personal data as long as they are relevant for our communication with you.

The retention period related to surveys is decided by the type of survey. Usually we will analyze the responses, and then use it in anonymized and aggregated form for sharing with clients, business partners etc. without anyone being recognized. More information will follow in the survey you receive.

If you have confirmed a client’s ID we will process the information provided by you; name, position, contact information and personal identification number.

We may process your contact information for prospect-purposes if you are a potential client.

Purposes

  1. We process the personal data in order to

    1. contact you after you have asked for an initial conversation. If we enter into a client agreement we will process the personal data in order to administer our client relationships.
    2. provide our services and document our performance,
    3. fulfill our legal obligations for documentation,
    4. if you ask for it we make sure that your pension capital information is available at your profile at Söderberg & Partners Wealth Management
    5. for prospects.

Where does the personal data come from?

The data may come from our business partners who you have a client relationship with and have consented to them providing us with your information, or you may give us your information yourself. We may also collect information form previous employers and public records if this is necessary to fulfill our agreement with you or to prepare such agreement.

If you have confirmed a client’s ID the information is provided by yourself.

We also receive information from the Defined Pension Scheme-company to follow up on your client relationship and to provide you with our services at any time.

We may also collect information from public records or collect information from individuals, i.e. for prospect-purposes.

Lawfulness of processing

For purposes 1 and 5 it is in our legitimate interest to contact you in order to offer our services. For purpose 2 we process your personal data to fulfill our obligations with you, i.e. to provide and document our services.

For purpose 3 we process your personal data to fulfill our legal obligations, i.e. AML-legislations and other relevant legislations.

For purpose 4 the information about your pension capital provided to Söderberg & Partners Wealth Management is based on your consent, and this can be withdrawn at any time.

If a client relationship is not entered into, we will delete your personal data.

If a client relationship is entered into, we will process your personal data as long as this client relationship is active. After a client relationship is ended we will process your personal data as long as it is necessary to document our services and to fulfill our legal obligations. Relevant legislation is the Act relating to the limitation period for claims, Act on Bookeeping and AML – up to 13 years.

Contact information: If you are the client’s contact person or a private client (a physical person) we will collect and process your name, e-mail address, mail address, phone number and profession. We process your contact information when providing financial managing services and additional services because it is necessary to establish and administer our client relationship with you, and to fulfill the agreement(s) we have entered into with you.

ID Control: We perform ID-control etc., and collect documentation that confirms the client’s identity, and we perform power of attorney- or representation control. Söderberg & Partners WM processes these personal data to fulfill its obligations by law for AML-purposes.

Financial position, risk appetite, goal, knowledge and experience:

For a safe and holistic investment advice it is a premise that Söderberg & Partners WM collects information regarding the client’s financial placements, economical situation, personal affairs, investment goals and risk appetite. The information is processed in the wealth plan which is created personally for every client. We process these personal data in order to perform the suitability test after the Securities Trading Act § 10-15.

Transactions and client account balance:

We process information about the client’s transactions and client account balance. We process this information because it is necessary in order for Söderberg & Partners WM’s legal obligations.

Purposes

  1. To verify your identity. For this purpose we use contact information and payment information.
  2. To deliver our services. For this purpose we use technical information.
  3. For billing. For this purpose we use contact information and payment information.

Lawfulness of processing

The legal basis for purpose 1, 2, 3, 4 and 5 is that it is necessary to perform the contact we have entered into with you and it is necessary for us to fulfill our legal obligations (such as AML, Securities Trading Act and book keeping). The legal basis for purpose 6, 7 and 8 will be consent. The legal basis for purpose 9 is that it is in our legitimate interest to develop our business.

Recipients of personal data

Your information may as a result of legal obligations be transferred to public entities. If we perform management and investment advice to you your personal data may be transferred to securities markets (market places, settlement centers etc.) who by law or other rules demand certain information.

Söderberg & Partners WM may give their suppliers access to your personal data if these suppliers provide maintenance, operations, or other technical solutions to Söderberg & Partners WM. To secure your rights after the data protection legislation we have entered into the necessary data processor agreements with the suppliers that may access and process your personal data on our behalf. Our suppliers do not have the right to use the personal data for other purposes and those described in this privacy notice. Our suppliers have a duty to enter into similar data processor agreements with their suppliers (sub-processors), who ensure that the sub-processors have the same obligations as our suppliers.

We will delete or anonymize personal data when it is not longer necessary for the purposes they were collected for:

Personal data described under investment products and investment services in this privacy notice will be processed and stored as long as a client relationship is established, as well as the timeframe that follows by law – i.e. book keeping, AML and Securities Trading Act.

Personal data which we process for marketing purposes will be stored as long as a client relationship is established. We consider a client relationship to be established as long as you have received a service from us during the last 12 months, or you have been in contact with us during the same timeframe.

We are not obliged to delete your personal data if the data is necessary in order to fulfill our legal obligations, or to establish, exercise of defend a legal claim.

Voice recording of phone calls

Söderberg & Partners WM records every phone call with potential and active clients as a result of legal obligations for securities businesses in Norway. The recordings will be stored for a minimum of five years in accordance with the Securities Trading Act. Records may be controlled by our Compliance-department. Your wealth manager may in certain cases listen to the recording for control purposes if there are uncertainties regarding details of the call which may affect the investment advice or services. Compliance receives notification about records, and it is logged. Söderberg & Partners WM may be obliged to transfer recordings and other documentation tied to communication channels to public entities that demand this by law.
